These Terms govern the use of the Malmahi Platform and the relationship between Malmahi, Customers, and Experts. Please read them together with the Privacy Policy, Cancellation and Refund Policy, Safety Policy, and any rules displayed within the Platform. By creating an account, selecting an acceptance button, confirming a booking, or accepting a request, you confirm electronically that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Platform.

Nothing in these Terms excludes a mandatory right under the laws of the Kingdom of Saudi Arabia. Any provision that conflicts with a mandatory right will be interpreted only to the extent necessary to comply with applicable law.

Part One: General Terms

1. Definitions

  • Malmahi or the Platform means the website, Customer App, Expert App, and related services and systems operated by the Saudi establishment legally registered as صالون ملمحي الرقمية للتزيين النسائي.
  • Customer means a user who searches for, books, or pays for a service for herself or another permitted female beneficiary.
  • Expert means an independent female service professional registered and approved through the Expert App.
  • Standard Service means a listed service whose base price, description, and expected duration are set by Malmahi.
  • Custom Request means a request for an unlisted or non-standard service to which Experts may respond with proposals and prices for the Customer to accept.
  • Travel Fee means an amount separate from the Service Price, calculated using distance bands configured by the Platform and allocated to the Expert under these Terms.
  • Instant or On-Demand Booking means a request that may be broadcast to eligible, nearby, and available Experts according to location, service range, and matching factors.
  • Content means text, images, ratings, messages, files, and any other material uploaded or sent through the Platform.

2. Scope and Acceptance

These Terms apply to visitors, applicants, Customers, and Experts and to every booking, request, payment, or communication made through the Platform. The Privacy Policy and any cancellation, refund, safety, or other instructions shown before an operation is confirmed form part of these Terms.

3. Eligibility and Women Only Platform

Malmahi is a women-only services platform. An independent account holder must be at least 18 years old and legally capable of contracting. If a service is booked for a minor female beneficiary, the booking must be managed by her female guardian or another responsible adult woman, who must attend where appropriate. A service may not be booked for a man, and the identity of the actual beneficiary or the nature of the service location must not be concealed from the Expert.

4. Accounts Verification and Security

  • You must provide accurate and current information and use a mobile number and email address that you can access.
  • You are responsible for keeping verification codes and login credentials confidential and for account activity unless you promptly report unauthorised use to Malmahi.
  • Malmahi may request additional identity, eligibility, payment-method, or document verification where lawful and necessary.
  • You may not create an account in another person's name, sell or transfer an account, or share it in a way that breaches security requirements.
  • Malmahi may refuse registration or restrict an account if verification is incomplete or fraud or a breach of these Terms is suspected.

5. Malmahi's Role

Malmahi provides an electronic marketplace connecting Customers with independent Experts and facilitates service listings, matching, booking, communication, payment, and support. Unless expressly stated, Malmahi does not itself perform beauty services, and an Expert is not Malmahi's employee, agent, or partner. The service arrangement is formed between the Customer and Expert through the Platform, subject to Malmahi's rules.

Malmahi may set Standard Services, prices, travel-fee bands, quality rules, and acceptance standards. This alone does not create an employment relationship with an Expert. Malmahi does not guarantee that an Expert will be available for every request, that a request will be accepted, or that a particular subjective beauty result will be achieved.

6. Electronic Contracting and Notices

Electronic acceptances, instructions, confirmations, and records generated through the Platform may evidence operations performed through an account to the extent permitted by law. Operational notices may be sent through the application, SMS, email, or push notification. You must keep your contact details current.

7. Intellectual Property

Malmahi or its licensors own the Platform, brand, logos, designs, software, text, databases, and content created by Malmahi. You receive a limited, personal, non-exclusive, non-transferable licence to use the Platform only for permitted purposes. You may not copy, scrape, reverse engineer, interfere with, or use Malmahi's brand without written permission.

8. User Content

You retain your rights in Content you upload and grant Malmahi a non-exclusive, royalty-free licence necessary to host, display, process, and use that Content to operate the Platform and market an Expert profile within it for as long as the Content remains available or is reasonably needed for a lawful purpose. You confirm that your Content is accurate and lawful and does not infringe privacy, intellectual property, or other rights.

9. Privacy

Malmahi processes personal data under its published Privacy Policy. Do not send identity documents, bank details, or sensitive health information in chat unless Malmahi requests them through a dedicated secure channel.

10. Prohibited Conduct

  • Fraud, impersonation, or misleading information, documents, or ratings.
  • Harassment, threats, abuse, discrimination, or recording or photographing a person without consent.
  • Booking a service for a man or luring an Expert to a location or beneficiary different from what was disclosed.
  • Requesting or offering an unlawful, unsafe, or medical service without the required qualifications or licence.
  • Hacking, disrupting, scraping, or introducing malicious code to the Platform.
  • Avoiding fees, Commission, or Platform payment by moving a Platform-generated booking off the Platform.
  • Using the other party's data after a booking for an unrelated purpose or without a lawful basis.

11. Account Suspension or Termination

Malmahi may suspend, restrict, or close an account for a breach of these Terms or law, a safety risk, failed verification, fraud, repeated cancellation, serious complaints, or unpaid amounts. Notice and reasons will be provided where appropriate and permitted, subject to urgent safety action. Closure does not affect rights and obligations accrued before closure.

12. Platform Availability and Updates

The Platform or certain features may be updated or temporarily unavailable for maintenance, security, or development. Malmahi works to maintain availability but does not guarantee uninterrupted or error-free operation at all times. A material change will not impair a mandatory right or a confirmed booking without appropriate remediation.

Part Two: Customer Terms

13. Booking Methods and Requests

  • Expert selection: a Customer may select an available Expert based on her profile, services, location, and ratings.
  • Instant or on-demand request: the request may be broadcast to eligible Experts using proximity, service range, availability, and matching factors. A booking is not confirmed until an Expert accepts and confirmation appears.
  • Custom Request: the Customer describes the requirement and Experts may submit proposals and prices. A booking is formed only after the Customer selects and confirms a proposal and completes or authorises the required payment.
  • The Customer must review the description, price, duration, Travel Fee, expected arrival, and cancellation terms before confirming.

14. Prices Travel Fees and Payment

The Service Price, Travel Fee, and any tax or other charge will be displayed before confirmation. Malmahi sets the Standard Service Price. The price of a Custom Request is set in the Expert's proposal accepted by the Customer. The Travel Fee is calculated separately using the Expert's distance or an approved distance band and may become final only after an Expert is selected or assigned.

Payments are processed through Tap Payments or another authorised provider. The amount may be authorised, charged, or settled as shown before confirmation. The Customer is responsible for a valid payment method and sufficient funds and must not improperly dispute a valid transaction to avoid payment.

15. Customer Duties and Service Location

  • Provide an accurate address, map location, contact number, and safe access instructions.
  • Ensure the beneficiary is female and the service location protects the privacy and safety of both Customer and Expert.
  • Do not have a man as the beneficiary or unexpectedly present in the service area in a way that compromises the Expert's privacy or safety.
  • Be ready at the agreed time and provide stated household requirements such as suitable space, water, or electricity where needed.
  • Before the service begins, disclose allergies, skin conditions, injuries, pregnancy, medication, or any circumstance relevant to safe performance.
  • Treat the Expert respectfully and do not request additional work outside the booking unless it is added and approved through the Platform.

If the Expert discovers that the beneficiary is male, the beneficiary or location was concealed, or the location is unsafe, she may refuse entry or leave immediately and contact support or use safety features.

This will be treated as a Customer breach, and the disclosed cancellation or Travel Fee may apply, without limiting any right to report the incident to the competent authorities.

16. Cancellation Rescheduling No Show and Refunds

The Cancellation and Refund Policy displayed before the booking is confirmed forms part of these Terms. Charges or refund eligibility may depend on the time of cancellation, Expert acceptance, travel or arrival, special materials purchased, and whether the service has started. Where possible, the expected charge will be shown before cancellation is confirmed.

  • If the Expert cancels or cannot perform because of circumstances attributable to her, the Customer may rebook or receive a refund for the unperformed portion in accordance with law and policy.
  • If the Customer does not attend, cannot be reached, or provides an incorrect address, the booking may be treated as cancelled by the Customer and disclosed charges may apply.
  • Refunds are ordinarily returned to the original payment method and may take additional time to appear through the bank or payment provider.
  • This Policy does not limit mandatory rights under the Saudi E-Commerce Law or other applicable law, including rights relating to delay, non-performance, or defect where applicable.

17. Booking Communications

Booking chat is for service coordination. Text, voice messages, photographs, or attachments may be enabled at particular booking stages, including after the Expert arrives. Abusive or unlawful content and unnecessary images of persons or homes are prohibited. Malmahi may retain communications as described in the Privacy Policy for support, safety, and dispute resolution.

18. Ratings and Complaints

A rating must be honest and based on a genuine booking and must not contain abuse, defamation, or unnecessary personal data. Malmahi may use multiple criteria such as quality, cleanliness, punctuality, and accuracy and may verify or remove fraudulent or unlawful ratings. Complaints should be submitted with available details and evidence within a reasonable time after the service.

19. Safety and SOS

Malmahi may provide safety features that allow booking and location information to be shared with the support team and enable contact with support, competent authorities, police, or emergency services where appropriate. SOS is an assistance feature and does not replace directly calling official emergency numbers. It must be used in good faith for a genuine concern. Information necessary to protect persons and investigate a report may be shared with competent authorities.

20. Beauty Results and Health Safety

Results vary according to hair, skin, nails, products, prior condition, and personal expectations. Customers must disclose relevant allergies and conditions and follow after-care guidance. Experts must stop where a clear safety risk appears. Platform services are not medical diagnosis or treatment. Any activity requiring a healthcare professional or medical licence must not be requested or offered as an ordinary beauty service.

Part Three: Expert Terms

21. Registration Verification and Tap Requirements

An Expert must be a woman aged 18 or over and provide accurate identity, experience, qualification, bank, and activity information. She must first obtain Malmahi approval and then complete Tap Payments verification where required. New booking requests may remain unavailable until all approvals and financial verification are complete.

Documents must be updated when they expire or change. An Expert may not send another person to perform a booking, use another Expert's account, or subcontract without Malmahi's written approval.

22. Independent Expert Status

The Expert provides services as an independent professional and is not Malmahi's employee, worker, agent, or partner. She chooses her working hours and service area and may accept or reject requests, while remaining responsible for accepted bookings. She bears the cost of her tools, travel, communications, professional obligations, licences, tax, and insurance unless expressly agreed otherwise in writing.

23. Service Performance Standards

  • Attend on time and perform the confirmed description within a reasonable duration and scope.
  • Use clean, safe, genuine, and suitable products and tools and comply with hygiene, infection-control, and professional requirements.
  • Act respectfully, protect Customer privacy and location, and do not photograph a Customer or her home without express consent.
  • Do not perform outside your competence or licence or where a health or safety concern is apparent.
  • Notify the Customer and Platform promptly of delay, inability to attend, or an incident, and do not pressure the Customer to cancel on your behalf.
  • Do not add charges, change scope, or collect off-Platform payment outside what the Platform approves.

24. Standard Service Prices and Travel Fees

Malmahi sets a uniform base price for Standard Services. An Expert may not change it or request an additional off-Platform amount. The Travel Fee is calculated separately using distance and bands configured by Malmahi. When earned under the completed-booking and cancellation rules, the full Travel Fee is allocated to the Expert and is excluded from Malmahi's Commission.

Malmahi may change prices or Travel Fee bands prospectively. A change will be shown before the Expert accepts an affected booking and will not apply retrospectively to a confirmed booking unless the parties agree or law requires it.

25. Custom Request Pricing

An Expert may set the price, description, and expected duration of her Custom Request proposal based on the available information. The proposal must be complete and clear. An Expert may not quote an artificially low amount and then request additional off-Platform payment. The proposal becomes binding when accepted and confirmed unless requirements materially change and a revised amount is approved through the Platform.

26. Malmahi Commission and Settlements

  • Malmahi earns a 17% Commission on the base price of each completed Standard Service booked through the Platform.
  • For a Custom Request, Malmahi earns a 17% Commission on the price proposed by the Expert and accepted by the Customer.
  • Malmahi's Commission is not charged on the separate Travel Fee.
  • Net Expert earnings are paid through Tap Payments or the authorised settlement provider according to the available settlement cycle, after deducting Commission, refunds, chargebacks, and any disclosed statutory or third-party amounts.
  • A discount funded by Malmahi will not reduce the Expert's entitlement unless that effect is disclosed and accepted before the booking. An Expert-funded discount will not apply without her consent.
  • The Expert must review transaction records and raise an objection through support within the reasonable period stated in the Platform.

27. Expert Cancellation Delay and Non Performance

After accepting a booking, an Expert must perform it and may cancel only for a genuine reason. Repeated cancellation, delay, non-attendance, or pressuring a Customer to cancel may reduce visibility, restrict requests, or suspend the account, taking emergency circumstances and evidence into account. The Expert may be responsible for amounts refunded because of her established breach to the extent permitted by law and policy.

28. Non Circumvention and Off Platform Dealings

An Expert or Customer may not move a booking or relationship introduced through Malmahi off the Platform to avoid Commission, payment controls, or safety rules, or exchange external payment details for that purpose. This does not restrict a provable independent relationship that existed before and did not arise from Malmahi. Account action and recovery of amounts due may follow established circumvention.

29. Licences Taxes and Insurance

The Expert is responsible for every licence, permit, certificate, or insurance required for her activity and for her tax, zakat, and accounting obligations under applicable law. Account approval is not a permanent confirmation that every document remains valid. Malmahi may require updates or reverification.

30. Location Privacy and Safety

When an Expert activates availability or accepts a booking, precise or background location may be required for matching, Travel Fee calculation, navigation, journey tracking, and safety. She may not use a Customer's address, number, or location images after the booking except for a lawful service or complaint purpose. If the beneficiary or location is inconsistent or unsafe, the Expert may leave immediately, contact support, use SOS, or call police or emergency services as appropriate.

31. Quality Ratings and Enforcement

Malmahi may monitor acceptance, cancellation, punctuality, quality, hygiene, complaints, and ratings and may use them for ranking, training, warning, or restriction. A material action will not be taken solely on one automated rating without an opportunity for review where law or fairness requires it. The Expert may challenge an action and provide evidence through support.

Part Four: Final Legal Terms

32. Third Party Services

Certain features depend on third parties such as Tap Payments, mapping, communications, hosting, and app stores. Your direct relationship with those providers may be subject to their terms and policies.

Malmahi is not responsible for an outage outside its reasonable control but remains responsible for its legal duties in selecting and managing processors acting on its behalf.

33. Disclaimers

Expert profiles rely on information provided by Experts and available verification processes, and Malmahi does not guarantee that all information will remain error-free at all times. Malmahi does not guarantee acceptance of every request, exact arrival times outside reasonable control, or a particular subjective beauty outcome. This does not limit Malmahi's responsibility for its own information, legal obligations, or proper handling of a valid complaint.

34. Limitation of Liability

To the extent permitted by law, Malmahi is responsible for proven direct loss attributable to its breach and is not responsible for indirect or unreasonably unforeseeable loss or loss caused by a Customer, an Expert, inaccurate information, or a service performed by an independent Expert. Nothing in these Terms excludes liability that cannot lawfully be excluded, including fraud, gross fault, or mandatory consumer rights.

35. Indemnity for Breach

To the extent permitted by law, a user is responsible for direct and reasonable loss and cost incurred by Malmahi because of that user's intentional or gross breach of these Terms, law, or third-party rights, after notice and a reasonable opportunity to respond. This clause will not be applied to reduce mandatory consumer rights.

36. Force Majeure

A party is not in breach where performance is prevented by an event beyond reasonable control, including disaster, widespread communications failure, official action, security events, or epidemic conditions, provided notice is given where possible and reasonable steps are taken to reduce the effect. Amounts relating to an unperformed service will be handled under applicable law and policy.

37. Complaints and Dispute Resolution

A complaint should first be submitted through Malmahi support or to support@malmahi.app with the booking number, facts, and available evidence. Malmahi will seek to review and respond within a reasonable or legally required period. This does not prevent a Customer from using Ministry of Commerce or other competent channels or any party from applying to a competent court.

38. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia, including laws relating to ecommerce, electronic transactions, data protection, and consumer protection. Any dispute not resolved amicably will be subject to the competent Saudi authorities and courts, subject to mandatory jurisdiction and consumer rules.

39. Changes to these Terms

Malmahi may update these Terms when services or legal requirements change. The updated version and date will be published, with additional notice for a material change. A material amendment will not apply retrospectively to a confirmed booking without consent or legal basis. Acceptance of updated Terms may be required before continued use.

40. Miscellaneous

  • If a provision is unenforceable, the remaining Terms continue and the provision will be interpreted as closely as possible to its lawful purpose.
  • Failure by Malmahi to enforce a right at one time is not a waiver.
  • A user may not transfer rights or obligations without Malmahi's consent. Malmahi may transfer them as part of a legitimate reorganisation or business sale while preserving mandatory rights.
  • These Terms and incorporated policies govern Platform use without replacing any separate written commercial agreement with an Expert.

42. Governing Language

These Terms are available in Arabic and English. If there is any inconsistency of interpretation, the Arabic version will prevail to the extent permitted by the laws of the Kingdom of Saudi Arabia.
